18-WHEELER ACCIDENT CAUSED BY TRUCK’S FAILURE TO YIELD
The deadly tractor-trailer accident took place at around 7:30 a.m. on July 26, 2012, as Carly Mary Rose Deemer was traveling west in the outside lane of U.S. Highway 84, where it intersects with U.S. Interstate 49, with Georgia Ann Wilson as her passenger. At the same time, John R. Cline was driving his tractor-trailer rig south on the southbound I-49 exit ramp, when he ignored the stop signs showing in his direction, failed to yield to the right of way of Deemer’s vehicle, and caused the collision. Both Deemer and Wilson suffered fatal injuries in the wreck.
In the lawsuit, Cline is accused of negligence, of failing to obey traffic controls, failing to maintain a proper lookout, failing to yield the right of way to Deemer’s vehicle, failing to timely apply brake, entering the intersection when it was unsafe, and for failing to maintain proper control of his tractor-trailer. The surviving parents of the truck accident victims are asking for an award of damages for pecuniary losses; loss of companionship and society; loss of care, support, maintenance, counsel and services; and damages for Wilson’s emotional pain, mental anguish, torment, suffering, and funeral and burial expenses.
