Around 11:30 a.m., Rios was headed east in an SUV carrying his two children on Borgfeld Drive near Bulverde Road, when he collided with a Ford F-250 pickup heading west. Rios was off duty but in his uniform at the time of the crash, and pronounced dead at the scene. His two children were flown to University Hospital with injuries described as serious, but not life-threatening, reported Keith. “It’s too early to determine the specifics of how this accident happened,” he said. “That’s something that we will investigate.”

The driver of the pickup, who was not named, was transported to North Central Baptist Hospital in stable condition. While the driver said he was alone in the F-250, witnesses reported seeing passengers take off running after the crash, Keith said. SAPD’s helicopter scoured the area to search for any suspicious activity. Authorities stated that the truck is owned by a construction company and the authorities have contacted the company to determine whether anyone else was in the vehicle.

SAPD interim Chief Anthony Teviño said Rios death came as a bit of a shock. “I think that we understand the job as a police officer and know its got its inherent dangers, but when it happens in this kind of incident, when it’s off-duty, you know, it’s kind of a little bit more of a shock to the senses,” Treviño said.

Rios, a 6-year-veteran of the department, worked at the South Patrol substation, according to SAPD. He is survived by his wife and four children. “It really just kind of brings home the fact that things like this can happen anywhere at anytime to anybody. Our hearts and thoughts go out to the family and we’re going to be there to support them.”

If your family has recently suffered a loss because of a car accident, you may be entitled to compensation. Bandas Law Firm can help you in this difficult time and fight to bring your family justice and financial support.  Like other states, Texas allows its citizens to sue for wrongful death. When someone is killed, his spouse, parents, or children may bring the wrongful death suit against the other party. Texas law does not allow siblings to initiate wrongful death lawsuits. It is also important to remember that in Texas there is a statute of limitations for wrongful death claims. You must file your claim within two years of the death, or you will not be able to file one at all. Like other personal injury claims, you will either argue that the damage was intentional or due to negligence. If you are arguing that the defender was negligent, you will have to show that they did not exercise a reasonable standard of care and that the negligence was a cause of the death. In car accident fatalities, you may also be able to prove that the defendant’s behavior was reckless. This will also entitle you to damages.
