Burned Oil Worker Reaches $10 Million-Plus Settlement With Texas Company

A Montana man severely burned in a 2010 oil patch fire in the Bakken formation has reportedly reached a multimillion-dollar settlement with a Texas oil and gas company accused of failing to provide the worker with adequate training and safety equipment. Thirty-year-old Lester “Gary” Roberts suffered disfiguring burns to his face, head, hands and chest in the November 2010 fire, and his attorney says the permanent injuries will prevent him from ever working again. Lack of Safety Training, Equipment May Have Caused Burn Injuries
The fire that resulted in Roberts’ burn injuries took place while he was employed as a contractor at a drilling rig in North Dakota. The oil worker filed the lawsuit against EOG Resources Inc. of Houston, Texas back in March 2012, alleging that he was not sufficiently trained by the company and lacked the required flame-retardant clothing. The complaint also alleged that there were no working fire extinguishers on-site when the workplace accident occurred.
According to court documents, Roberts was not directly employed by EOG, but the oil and gas company was in charge of the drilling operation and had an employee on-site at the time of the accident. Since being involved in the on-the-job accident, Roberts has undergone more than a dozen surgeries, and could require as many as 20 more as he continues to recover from the extensive burns covering his body. “I hope by bringing this incident to light, it will hold companies working in the Bakken accountable and remind them that safety needs to be more than a slogan on the side of a truck,” said Roberts after the settlement agreement was made.

After Roberts and EOG settled the claim, the former oil worker’s attorney described the settlement as a “substantial eight-figure sum,” which means the agreement is worth at least $10 million.
