TEXAS WORKER SUFFERS FATAL INJURIES ON JOB SITE

Felipe Jaimez Perdomo died on May 9, near a residential construction site in Northwest Austin, after a machine used to dig trenches rolled down a hill and fell on top of him. According to police, after trying to help jump-start a SkyTrak forklift with a trencher, Perdomo drove the trencher back up to the construction site at the top of a steep hill. A witness reported that Perdomo then attempted to stop the trencher, but it continued to roll back down the hill, struck a curb and flipped over numerous times, pinning the 37-year-old underneath the machine. As a result of the devastating accident, Perdomo suffered head trauma, his left arm was severed, and he was pronounced dead at the scene.

EMPLOYER, MANUFACTURER ACCUSED OF GROSS NEGLIGENCE

In the wrongful death lawsuit, which was filed in Travis County District Court on July 10, Perdomo’s family accuses Vermeer Manufacturing Company and Vermeer Equipment of Texas, Inc., of manufacturing a “defective and unreasonably dangerous” trencher machine. The family also accuses M.J. Sheridan of Texas, Inc. – the worker’s employer at the time of his tragic death – of failing to adequately maintain and/or monitor the trencher, including warning Perdomo of the trencher’s danger. In their suit, Perdomo’s mother and the mothers of his three children are pursuing more than $1 million in damages for funeral and burial expenses, and loss of inheritance and companionship.
