Inc. and JBS Carriers Inc. on April 16, in Smith County District Court, and was removed by the defendant to the Eastern District of Texas, Tyler Division. In his complaint, Harmon accuses Wilcox of negligence in the accident that occurred on May 9, 2011, when Wilcox’s truck collided with the rear of Harmon’s vehicle and allegedly caused his life-threatening injuries. According to the Texas personal injury lawsuit, Wilcox is accused of negligence for failing to control his speed, failing to keep a proper lookout, failing to make timely application of breaks, failing to reduce his speed, driving too fast for the conditions, and for operating his vehicle in an improper and unsafe manner.
