Wrongful Death Lawsuit Filed Over Fatal Trucking Accident In Texas

The parents of a 24-year-old killed in a fatal truck accident earlier this year have filed a wrongful death lawsuit against the trucking company whose driver failed to yield the right of way and caused the collision and subsequent death. Pedro and Julita Reyes filed suit against truck driver James Dean Stanton, Anderson Trucking Services Inc. and Farmers Texas County Mutual Insurance Co. on November 14, in the Polk County District Court, after which the case was removed to the Eastern District of Texas, Lufkin Division. Driver’s Failure to Yield Results in Fatality
The deadly trucking accident occurred on May 29 and involved a 1993 Mazda operated by Urias Reyes and a 2006 Freightliner Truck and trailer operated by Stanton. Reyes was traveling northbound on U.S. 59 in Polk County while Stanton was pulling out of the Exxon truck stop. Stanton was preparing to turn in the southbound direction and was stopped to wait for traffic to clear, leaving his trailer blocking the northbound lanes. According to the wrongful death suit, Reyes was unable to stop or avoid the accident and struck the left side of the trailer, which resulted in his death.
Stanton has been accused of negligence for a number of things, including failing to turn his vehicle in an effort to avoid the collision; for failing to watch out for Reyes’ safety; for operating his vehicle in Reyes’ lane of traffic; for failing to accelerate his vehicle in a timely manner; for inattentively operating his vehicle; for failing to keep such distance from Reyes’ vehicle as a person using ordinary prudent care would have done; for stopping his vehicle in a live lane of traffic; and for failing to yield to Reyes’ right of way.
