Jury Awards Texas Man $11 Million For Oil Field Accident Injuries

A West Texas jury awarded $11 million last week to a man who suffered serious injuries in a Texas oil field accident that occurred when a pipe casing fell from an oil field elevator and landed on him. The verdict delivered in favor of the Texas man was announced on October 22, 2012, after a week-long civil trial in Ector County, Texas. The jury found that the elevator sold by the defendant, M&M Elevator Company, was defective at the time of the oil field accident, but that any negligence on the part of the company did not directly result in the Texas worker’s accident. The Texas oil field worker sued M&M Elevator Company after the September 2009 accident, in which the pipe casing that fell ripped nerves out of his neck and shoulder. A pipe casing is a load-bearing piece of equipment that closes around a pipe or other component, in order to help lower it in and pull it out of oil wells. In the opening statements of the oil field accident trial, the injured worker’s attorney claimed that the elevator malfunctioned, causing the casing to be dropped on the Texas man. Defense attorneys representing M&M Elevator Company, which sold the oil field elevator, argued that the elevator was checked earlier that same day for problems, had never malfunctioned before, and was improperly latched by the oil field workers. The company also claimed that the Texas oil field worker injured in the accident should have been standing under the elevator in the first place.


In its verdict, the jury awarded roughly $9,834,180 to the injured worker, in addition to $1 million in exemplary damages awarded to the worker and his family. The worker’s family was also awarded $480,000 for the loss of “parental consortium” related to his injuries.
